Sales and Delivery Terms
1. Validity of the Sales Agreement, Product, and Pricing Information
1.1. These sales terms apply to all purchases made in the online store Lacshary.ee.
1.2. By making a purchase, the buyer confirms that they have read and agree to the sales terms.
1.3. Product prices are listed on the product pages. All prices are in euros and include VAT (Value Added Tax). Shipping costs, which depend on the delivery method and the buyer’s location, are added to the price.
1.4. Shipping costs are calculated and displayed to the buyer during the order process and are added to the final order amount.
2. Placing an Order
2.1. To place an order, the buyer must add the desired products to the cart, fill in the required fields, and choose a delivery method. After this, the total order amount will be displayed, which can be paid via a bank link or another available payment method.
2.2. An order is considered placed and takes effect once the full payment has been received in the seller’s bank account.
2.3. If an ordered product cannot be delivered (e.g., due to it being out of stock), the buyer will be informed as soon as possible. The amount paid, including the shipping cost, will be refunded no later than 14 calendar days after the notification.
2.4. The seller reserves the right to refuse to fulfill an order if fraud is suspected, the contact details provided are inaccurate, or the buyer cannot be contacted.
3. Delivery
3.1. Delivery is carried out via Itella SmartPOST and Omniva parcel machines.
3.2. Free delivery in Estonia for orders over 59 €.
3.3. Products are delivered to the following countries: Estonia, Latvia, Lithuania, and Finland.
3.4. Delivery costs:
- Omniva (in Estonia): 3.18 €
- Omniva (to Latvia): 6.00 €
- Omniva (to Lithuania): 7.90 €
- Itella SmartPOST (in Estonia): 3.04 €
- Itella SmartPOST (to Finland): 11.00 €
3.5. Delivery times:
- Within Estonia: 1–3 business days from order confirmation.
- Outside Estonia: up to 14 calendar days. In exceptional cases, such as delays by the carrier, delivery may take up to 45 calendar days.
3.6. The buyer is responsible for providing an accurate and correct delivery address.
3.7. Once the parcel is delivered to the parcel machine, the buyer will receive an SMS with a code to open the locker.
3.8. The code must be entered into the parcel machine’s display, after which the locker containing the buyer’s parcel will open.
3.9. Damage during transportation: The seller is not responsible for any damage that occurs during transportation. Any claims regarding damage must be directed to the delivery company. The buyer must inspect the package’s condition upon receipt and, if necessary, document the damage with the carrier.
3.10. Force majeure: The seller is not responsible for delays caused by force majeure events, such as natural disasters, strikes, logistics company disruptions, or other circumstances beyond the seller’s control.
- Right of Withdrawal
4.1. The owner of the online store https://lacshary.eu/ (hereinafter referred to as the Online Store) is Casanails OÜ (registration number 14135347), located at Läänemere tee 36-50, Lasnamäe linnaosa, Tallinn, Harju maakond, 13914, Estonia.
4.2. After receiving the order, the buyer has the right to withdraw from the transaction concluded in the Online Store within 14 calendar days. The right of withdrawal does not apply to legal entities. Returns are only accepted for products that have not been used for purposes other than verifying their properties, characteristics, and functioning, as would be possible in a physical store. If the product has been used for other purposes or shows signs of use or wear, the Online Store reserves the right to reduce the refund amount based on the decreased value of the product.
4.3. To return a product, the buyer must send a free-form request to the email address info@lacshary.eu no later than 14 calendar days from the date of receiving the product. The return shipping costs are borne by the buyer, except in cases where the return is due to an error by the Online Store (e.g., incorrect or defective product). The return must be supported by documentation confirming the handover of the product to the carrier. The Online Store will refund the amount paid for the defective product within 14 calendar days of receiving and inspecting the returned product.
4.4. The Online Store may refuse to issue a refund until the returned product has been received, the withdrawal request has been submitted, or proof of the product’s handover to the carrier has been provided.
4.5. The Online Store reserves the right to withdraw from the transaction and request the return of the product if the price of the product was mistakenly listed significantly lower than its market value.
4.6. Hygiene products (e.g., manicure materials) are not eligible for return after the original packaging has been opened, except in cases where a defect is discovered.
5. Right to Submit Complaints
5.1. The buyer has the right to submit a complaint to the seller within 2 months of discovering a defect by sending an email to info@lacshary.eu.
5.2. The seller is not responsible for defects that arise after the product is handed over to the buyer.
5.3. If a product purchased from the online store has a defect for which the seller is responsible, the seller is obligated to repair or replace the product. If repair or replacement is not possible, the full amount paid for the transaction will be refunded to the buyer.
5.4. The seller responds to complaints in writing within 14 calendar days.
5.5. The warranty applies only to manufacturing defects. The warranty does not cover normal wear and tear or damage caused by misuse. The seller’s liability is limited to the repair, replacement, or refund of the product.
6. Dispute Resolution
6.1. In case of disputes, the buyer should contact the seller by sending a complaint to info@lacshary.eu. If the buyer and the seller cannot reach an agreement, the buyer has the right to contact the Consumer Disputes Committee. Submitting a complaint to the committee is free of charge.
6.2. The seller reserves the right to change prices, delivery terms, and return policies without prior notice. Changes do not apply to orders placed before the changes took effect.
